Welcome to Eastwind Landscape & Maintenance. By engaging our services, you (the "Client") agree to the following terms and conditions. These terms ensure that we maintain our "No Shortcuts" standard while protecting both the Client and the Eastwind family team.
1. Scope of Service
Eastwind Landscape & Maintenance provides professional yard care, technical irrigation management, and seasonal snow removal. The specific scope of work, frequency, and pricing will be outlined in your individual service estimate.
2. Access to Property
The Client agrees to provide Eastwind team members access to the service area on scheduled workdays.
Please ensure gates are unlocked and pets are secured indoors.
For irrigation startups and blowouts, access to the main water shut-off (typically in the garage or basement) may be required.
3. Irrigation & Sprinkler Services
Blowouts: We recommend scheduling winterization by early October. While we use professional-grade equipment, Eastwind is not responsible for damage to irrigation systems that were not properly maintained, or for systems where the blowout was requested after a major freeze has already occurred.
Repairs: We will inform the client of any existing leaks or damaged heads discovered during maintenance.
4. Snow Removal
Service Trigger: Snow removal services are typically triggered at an accumulation of [X] inches, unless otherwise agreed upon.
Liability: While we strive for total safety, Eastwind is not liable for slip-and-fall accidents on ice or snow, nor for damage to hidden objects (curbs, landscape lighting, or irrigation components) obscured by snow accumulation.
5. Payment Terms
Invoicing: Invoices are sent via email upon completion of service or on a monthly recurring basis for maintenance contracts.
Due Date: Payment is due within [15] days of the invoice date.
Late Fees: A late fee of [5]% may be applied to balances exceeding 30 days past due.
6. The "No Shortcuts" Guarantee
We take immense pride in our work. If you are not satisfied with the quality of a specific service, please contact us within 24 hours. We will make it right at no additional cost. This guarantee covers the quality of the labor (e.g., missed weeds or grass clippings left on the street) but does not cover the health of plants/turf affected by extreme Utah weather or client-controlled watering schedules.
7. Cancellations & Terminations
One-time Services: Please provide 48 hours' notice for cancellations.
Recurring Contracts: Maintenance agreements may be canceled by either party with [30] days' written notice.
8. Governing Law
These terms are governed by the laws of the State of Utah. Any disputes shall be resolved in the jurisdiction of the Salt Lake region.
